Petitioner, already in custody, seeks bail in connection with Forbesganj P.S. Case No.861 of 2017, registered under Sections 414/34 of the Indian Penal Code.

Allegation in brief is that one person was arrested with liquor and he disclosed that he is involved in committing theft along with Pawan Kumar Mandal and others and on disclosure of Pawan Kumar Mandal, one stolen motorcycle was recovered from the house of the petitioner.

Learned counsel for the petitioner submits that the said motorcycle was left by his brother-in-law, Pawan Kumar Mandal and petitioner had had no knowledge about the vehicle

Patna High Court Cr.Misc. No.7549 of 2018(2) dt.08-02-2018 2/2 being stolen one, the petitioner has no criminal antecedent and he is in custody since 15.11.2017.

Having considered the said facts and circumstances, petitioner Niranjan Mandal @ Niranjan Kumar Mandal @ Niranjan Das is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S.
