The petitioner seeks bail in a case registered under Section 304B of the Indian Penal Code.

The prosecution case in brief is that daughter of the informant was tortured and assaulted and in consequence thereof, she was done to death for want of demand of dowry. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-08-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. According to the inquest report , the deceased is said to have sustained injury due to train

Patna High Court CR. MISC. No.14137 of 2019(4) dt.09-05-2019 2/2 accident. The allegation, made in the FIR is denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Simultalla P.S. Case No. 36 of 2018.
