The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30(a),36,41(i) of Bihar Prohibition and Excise Act, 2016. Petitioner No.1 is a female and has no criminal antecedent. Hence, let the petitioner No.1, above named, in the event of her arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in

Patna High Court CR. MISC. No.14870 of 2019(2) dt.11-03-2019 2/2 connection with Hussainganj P.S.Case No. 379 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

Petitioner No.2 is husband of petitioner No.1 and he has identical criminal antecedent, hence, I am not inclined to enlarge him on anticipatory bail. Accordingly, prayer is refused in connection with Hussainganj P.S.Case No. 379 of 2018 pending in the court of learned A.D.J.-II-cum-Special Judge, Excise Act, Siwan.

This application stands disposed of.
