This application is for grant of regular bail in connection with N.T.P.C. P.S.Case No.48 of 2017, for the offences under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is of recovery of huge quantity of liquor from the joint house of the petitioner and the other accused persons.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession rather from the joint house of the petitioner
Patna High Court Cr.Misc. No.42664 of 2017 (2) dt.14-09-2017 and he has nothing to do with the seized articles. The petitioner is in custody for about three months. Heard learned A.P.P. also.
Having heard both sides and in view of recovery of huge quantity of liquor at this stage I am not inclined to grant bail to the petitioner as such this application is disposed of with direction to the learned trial court that once the charge is framed in this case or the petitioner completes judicial custody of six months, the learned court below shall release the petitioner on bail in connection with N.T.P.C. P.S. Case No.48 of 2017 to his own satisfaction.
With the aforesaid observation, this application is disposed of.
