JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 24-12-2013 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners, at the initial stage of Barachatty P.S.Case no. 203 if 2011, were amongst the accused persons who had facilitated the crime after borrowing the criminals. However, were not sent up for trial, after conclusion of the investigation by the Investigating Officer though differing therefrom, have been summoned by the Chief Judicial Magistrate to face trial for an offence punishable under Sections 302, 120 B of the Indian Penal Code. The order impugned also speaks like so. On account thereof, petitioners, Janvijay Yadav and Uday Yadav @ Uday Kumar Yadav, each are directed to be released on bail on executing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the

satisfaction of the Subdivisional Judicial Magistrate, Sherghatty, Gaya, in the event of their arrest or surrender within four weeks in connection with Barachatty P.S. Case no. 203 of 2011 in terms of Section 438(2) of the Code of Criminal Procedure.
