The petitioner apprehends arrest in a case registered for the offence punishable under sections 363/365 of the Indian Penal Code.
As per the prosecution case, petitioner and other accused persons abducted daughter of the informant. Learned counsel appearing for the petitioner submits that the victim is major and was in love with the petitioner, which was not accepted by the informant, as such, this false case was lodged. There is delay of three days in lodging of the FIR and there is no explanation of delay. Petitioner claims clean antecedent.
Learned counsel for the State as well as the informant
Patna High Court CR. MISC. No.14667 of 2023(3) dt.22-06-2023 2/2 oppose the prayer for bail. They submit that the victim in her 164 Cr.P.C. statement while supporting the prosecution case has stated that the petitioner forcibly abducted and married her and made video of that occasion.
Considering section 164 Cr.P.C. statement of the victim, prayer for bail of the petitioner is dismissed. (Prabhat Kumar Singh, J) Shashi U T
