22.07.2020 Heard Mr. Asit Kumar Jha, learned counsel for the petitioner Mr. Brij Bihari Tiwari, learned counsel for the informant and Mr. Parmeshwar Mehta, learned counsel for the State.

The petitioners seek bail in anticipation of their arrest in connection with Sangrampur P.S. Case No. 268/2019 dated 06.12.2019 instituted for the offences under Sections 420m 409 and 120B of the Indian Penal Code.

The petitioners are the elected Ward Members of ward no. 9 and 11 of Gram Panchayat West Madhubani and East Champaran. They appear to have been implicated in this case on the allegation that instead of getting the work of Nal Jal Scheme executed through Kriyanwayan and Prabhandhan Samiti of the ward, it was executed elusively with the aid of local contractors.

Learned counsel for the petitioners has submitted that the aforesaid F.I.R. has been lodged as a retaliation to the dispute with respect to release of the fund . It has further been submitted that the entire work of Nal Jal Scheme has been executed and a report regarding the same has also been transmitted to the concerned officer. Some of the other accused persons of this case are stated to have been granted anticipatory bail by this Court.

Considering the afore-stated facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of

this order on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Sub Judge -14-cum-ACJM, Motihari, East Champaran, in connection with Sangrampur P.S. Case No. 268/2019 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. .
