The petitioner is seeking regular bail in Ramgarhwa P.S. Case No. 124/2016 registered for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 427, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that so far as the present petitioner is concerned there is no allegation against him of firing upon the deceased. The allegations of firing upon the deceased are specifically attributed against Sheikh Sayeed @ Bhulakkar and Sheikh Nisar. The allegation against this petitioner is that when the cousin nephew of the father of this informant went there, this petitioner fired from his pistol with an intention to
Patna High Court Cr.Misc. No.5383 of 2018 (2) dt.05-02-2018 2/2 kill but the fire missed and hit him in the right hand. Learned counsel further submits that there is no other allegation except the above and the petitioner has though got some cases mentioned in Paragraph 3 but he is on bail in all those case. Learned counsel for the State is present.
Considering the facts and circumstances, let the petitioner, named above, be enlarged on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Raxaul, East Champaran, Motihari in connection with Ramgarhwa P.S. Case No. 124/2016, subject to the conditions as laid down under Section 437(3) Cr.P.C. and that if he found involved in similar offences in future the Investigating Officer will have liberty to move an application for cancellation of bail of the petitioner.
