JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-04-2015 The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 325, 341, 448, 504/34 of the I.P.C. and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

Accusation is of making abuse after entering into the house of the informant.

It is submitted by learned counsel for the petitioners that as per the own admission of the informant the place of occurrence can not be treated to be a place of public view and the informant has subsequently retracted from the initial version and has filed a petition to that effect before learned Court below which has been brought on record Annexure-2.

Considering the aforesaid facts, let the

Patna High Court Cr.Misc. No.15970 of 2015 (2) dt.17-04-2015 2/2 petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur in connection with Khirimore P.S. Case No. 05 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
