This is an application for bail in connection with Dhamdaha P.S. Case No. 38 of 2017 registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code.

Allegation against the petitioner is of stabbing the brother of the informant causing his death.

Submission of learned counsel for the petitioner is that allegation is against other accused persons and not against him and post mortem report shows only two injuries on the person of deceased. Further submission is that petitioner is in custody for six months having no criminal antecedent and charges had been framed in this case.

Patna High Court Cr.Misc. No.33386 of 2017 (4) dt.04-09-2017 2/2 Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.

However, petitioner may renew his prayer for bail after framing of charge.
