The petitioner is an employee working in a Rice Mill owned by one Devesh Kumar Choudhary, who under an agreement with the State Food Corporation had taken certain quantity of paddy for milling but not deposited the same. The allegation is that he has defalcated the rice and thus he is liable to be prosecuted. The petitioner was not named in the F.I.R but being an employee, he has been subsequently implicated. No. 31117 of 2015, wherein this Hon'ble Court has already granted bail in anticipation of arrest to Devesh Kumar Choudhary. Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 155 of 2015, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure.
