On the pretext of sending the informant to foreign country he was deceived by one Kafil Ahmad. Huge sum of money was taken and during course thereof it is also evident that Rs.20,000/- was deposited in the account of petitioner also. It has been submitted on behalf of the petitioner that though he does not carry any sort of allegation nor he ever met with informant for that very purpose, even then he is ready to hand over the amount pertaining to Rs.20,000/- which had been deposited in his account by the prosecution party. Learned Additional Public Prosecutor as well as learned counsel for the informant do endorse the view expressed by learned counsel for the petitioner.

Thus, after payment of Rs.20,000/- in cash to the informant in presence of learned court below on proper identification as well as endorsement, petitioner Shakil Ahmad will be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Barari (Semapur) P.S. Case no. 14 of 2013 to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in event of his arrest or surrender within four weeks, in terms of Section 438(2) of the Code of Criminal Procedure.
