Petitioner seeks bail in a case registered for the offence punishable under Section 364A of the Indian Penal Code. The FIR of the occurrence of kidnapping of Satyam Kumar Mandal, the minor grand son of the informant is against unknown. Thereafter ransom was demanded for release of the victim from the referred mobile. During investigation, it revealed that the said mobile was of co-accused Amit Kumar Paddar.
Submission of the learned counsel for the petitioner is that the investigation is complete. The petitioner has got no criminal antecedent and co-accused Mukesh Paddar, similarly situated, has been allowed bail by this Court vide order
Patna High Court Cr.Misc. No.6416 of 2018 (3) dt.15-03-2018 2/2 dated 10.01.2018 passed in Cr. Misc. No. 58912 of 2017 (Annexure-8).
Learned counsel for the informant opposed the prayer for bail on the ground that the victim is still traceless. It has been informed that a criminal writ application brought by the informant for a direction to the Stateauthorities for recovery of the child has already been disposed of with some direction to the police.
Considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Biraul Police Station Case No. 274 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
