26-06-2023 Heard learned counsel for the parties.

The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 149, 341, 323, 324, 354(B), 379, 448 of the Indian Penal Code. Petitioner is alleged to have attempted to outrage the modesty of the informant.

It is submitted on behalf of petitioner that both parties are close door neighbours. Present case is counter blast of Town P.S. Case No. 290 of 2021, which was lodged against informant and others. Admittedly, there is land dispute between the parties and petitioner has filed a title suit, vide Title Suit No. 339 of 2017, against informant and her husband, on account of which, this false and fabricated case has been lodged. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.14705 of 2023(3) dt.26-06-2023 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with Town P.S. Case No. 288 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
