JUSTICE ARUN KUMAR ORAL ORDER 12-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.1.2018, seeks bail in Bihta PS Case No. 48 of 2018, Special Case No. 3 of 2018, registered under Sections 8 and 20(b)(II)A of the NDPS Act. The allegation in brief is that 22 grams of Ganja was recovered from the shop of the petitioner.

Submission is that the petitioner has no criminal antecedent, he is in custody since 19.1.2018 and the quantity is very small. Having considered the said facts and circumstances, the petitioner, namely, Habib Ansari is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge -cum- Special Judge, Patna in connection with Bihta PS Case No. 48 of 2018, Special Case No. 3 of 2018.
