2. The petitioners seek bail in connection with a case registered for the offence punishable under Sections 190/191(2)/ 115(2)/118(1)/109/74/351(2)/352 of the BNS.
3. As per the prosecution case, on 6-8-2024, at about 5:00 pm, while informant was sitting at this doorstep, all FIRnamed accused persons including these petitioners armed with pistols, rod and sticks attacked the informant and his family with the intention to kill.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.14887 of 2025(4) dt.11-07-2025 2/2 petitioners have been falsely implicated in this case due to dirty village politics. He further submits that as per F.I.R., the petitioner No. 3 hit on the head of the informant, petitioner No. 2 hit Devendra with an iron which caused serious injury on the head and waist whereas petitioner No. 1 hit the informant's brother, Suraj Kumar on his head with an iron rod due to which he sustained grievous injury. Learned counsel submits that on account of land dispute the occurrence took place. Case and counter case. Petitioners are in jail since 24.12.2024.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case and the period of custody, let the petitioners above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Pupri, Sitamarhi in connection with Nanpur P.S. Case No. 383/2024.
