JUSTICE SANJAY PRIYA ORAL ORDER 31-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Warisnagar P.S. Case No. 233 of 2016 instituted for the offence under Sections 364/34, 302 and 201 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he is not named in the written report. His name has been disclosed by co-accused Shravan Kumar who is alleged to have love affairs with the wife of the deceased prior to her marriage with the deceased.

In the written report it is alleged that son-in-law of the informant went to see fair (Mela), but he did not return. A telephone call was made by the daughter of the informant on the mobile phone of his son-in-law but his Mobile phone was

Patna High Court Cr.Misc. No.32394 of 2017 (3) dt.31-07-2017 2/2 switched off. It is further alleged that earlier Shravan Kumar had given threat to the son-in-law of the informant for not performing marriage with the deceased.

The name of this petitioner has been disclosed by Sharavan Kumar in his confessional statement as appear from the impugned order of the learned Sessions Judge. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Warisnagar P.S. Case No. 233 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
