ANJANA PRAKASH ORAL ORDER 28-08-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks cancellation of bail granted to the Opposite Parties No. 2 to 5 by the Additional Sessions Judge-III, Rohtas at Sasaram, in ABP No. 511 of 2015 arising out of Sheosagar (Baddi) P.S. Case No. 20 of 2015.
It has been submitted that some of the accused persons have been refused even regular bail by the Court below, and, hence, the Private Opposite Parties should not have been granted anticipatory bail in a case under Section 302 Indian Penal Code on the basis of Post mortem examination report.
Since this can be no ground for cancelling bail, the application stands rejected.
