The grievance of the petitioner in the present writ application is that after the decree passed in T.S.No.60/2001 on 30.07.2007 the execution case no.08/2007 is still pending and no step has been taken by the learned court below for further progress of the said execution case. The prayer therefore has been made for a direction to the court below to expedite the disposal of the said execution case in accordance with law. After considering the submissions and materials on record, it does not appear that any petition has been filed or any prayer has been made by the petitioner up-till-now before the executing court below, drawing the attention of the

Patna High Court CWJC No.9733 of 2014 (2) dt.17-05-2016 court about the pendency of the case and praying for early disposal. In this backdrop, this Court is not inclined to issue any such direction, as prayed. However, the petitioner shall be at liberty to pursue the remedy available to him in accordance with law.

The application is, accordingly, disposed of with aforesaid direction.
