The petitioner seeks bail in Peepara P.S. Case No. 157 of 2017 registered for the offence punishable under Section 387 of the Indian Penal Code.
Informant is one Gautam Rana, who in his written complaint has alleged that on 16.07.2017 in the night after dinner he was sleeping in his house and in the night at about 11:00 pm, he received a mobile call 3 to 4 times by one Satan Singh from central jail who asked him to pay Rs. 30,00,000/- within 24 hours or he will be eliminated. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case and
Patna High Court Cr.Misc. No.6145 of 2018(3) dt.27-02-2018 2/2 nothing has been recovered from his possession and he has no connection with said Satan Singh. He had only purchased mobile from one Saddam Hussain. The SIM from which ransom was demanded and the SIM which is used by the petitioner is different, however, it is alleged that it is the same mobile. It has been further submitted that the petitioner has got no criminal antecedent and is in custody since 09.11.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, in connection with Pipra P.S. Case No. 157 of 2017.
