2. Petitioner apprehend arrest in a case registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.

3. As per the prosecution case, it is alleged that petitioner despite receiving consideration money in advance refused to execute the sale deed in favour of the informant.

4. Learned counsel for the petitioner denies the allegation made against the petitioner and submits that petitioner has not received money either in cash or in her bank account. As a matter of fact the petitioner filed a complaint petition no. 1319 of 2021in the court of Chief Judicial Magistrate, Siwan on 23.10.2021. Moreover, there is no chit of paper on record in

Patna High Court CR. MISC. No.21556 of 2024(2) dt.04-04-2024 2/2 support of the allegation. Petitioner has clean antecedent.

Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court of the learned A.C.J.M.-IX, Siwan, District-Siwan in connection with Hussainganj P. S. Case No. 147 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
