Jale, District Darbhanga, formerly was serving in Bihar Regimental Centre as Army Havildar and retired after serving the army from the rank of Sepoy to the rank of Havilar with capacity to command, power of organization and general knowledge of routine nature cases with acute discipline, obedience, cheerfulness and was aware to maintain harmonious relation with superior Army Officers for continuous 21 years from the rank of Sepoy to the rank of Army Havildar and was posted from time to time in many Army Stations with effect from 22.4.1950 to 17.8.1971 without any complaint, allegation, 1 summary trial meaning thereby that his service career in Army remained neat and clean with therein zeal, fervor and many commendable adventurous life shown by the petitioner in active service.

JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 10-05-2016 Heard learned counsel for the petitioner and counsel for the Union of India as also counsel for the State Bank of India. The matter relates to grant of pension. The dispute is with regard to wrong entry of date of birth which led to reduction of Rs.

Patna High Court CWJC No.6508 of 2015 dt.10-05-2016 4,06,422/- from the pensionary amount claimed by the petitioner. The petitioner is an ex-army man. In view of Armed Forces Tribunal Act, 2007, the Union of India has already constituted Armed Forces Tribunal for redressal of the grievance of ex-personnel and army personnel.

In such view of the mater, the petitioner must approach to the Armed Forces Tribunal for redressal of his grievance and if the petitioner approach before the same, the Tribunal will take a decision and pass order in accordance with law.

With the aforementioned observation, this application is disposed of.
