JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 419, 420, 467, 468, 471, 34 of the Indian Penal Code. As per prosecution, the petitioner applied for the post of Driver in Police Department for Central Selection Council, Supaul and when physical measurement of the petitioner was being conducted his L.T.I. was not found matching on biometric machine and photo annexed on Admit Card and the form was also found different from the face of the petitioner. It has been submitted on behalf of the petitioner the petitioner has falsely been implicated in this case. It has been further submitted that the allegation against the petitioner that
Patna High Court Cr.Misc. No.34112 of 2017 (2) dt.20-07-2017 2/2 his finger print and photo was not found matching is without scientific tester and expert person. He has further submitted that at best a case under Section 419 IPC is made out against the petitioner. He has no criminal antecedent. He has been languishing in custody since 15.05.2017.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.N.Nigan,S.J. XV cum A.C.J.M., Patna, in connection with Hawai Adda P.S.Case No. 68 of 2017.
