The petitioner herein seeks anticipatory bail in Barahiya P.S. Case No. 206 of 2015, registered under Section 302/34 of the Indian Penal Code and 27 of the Arms Act. Altogether 13 accused persons including the petitioner are named in the First Information Report alleging that they were armed with country-made pistol and indiscriminate firing on brother of the informant was made, who was standing near the shop causing his instantaneous death.
The counsel for the petitioner submits that the allegation is general and omnibus. One of the brother of the informant was himself a veteran criminal.
Patna High Court Cr.Misc. No.13018 of 2016 (2) dt.18-04-2016 2/2 The A.P.P. for the State opposed the prayer and contended that the deceased received 11 bullets/fire arm injuries. Considering the allegation and the injuries sustained by the deceased, I am not persuaded to extend the privilege of anticipatory bail. The prayer is rejected.
