The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 392 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the informant and one another were going, it is stated that three accused persons on a motorcycle stopped them and after inquiring their name, one of the accused shot Amar Kumar as a result of which he died.
It is submitted by learned counsel for the petitioner that the FIR was registered against three unknown. The name of the petitioner transpired in course of investigation only on
Patna High Court CR. MISC. No.14839 of 2022(5) dt.06-01-2023 2/2 suspicion. It is submitted that even the paragraphs of the case diary which have been mentioned in the order of the learned Sessions Judge, witnesses in the said paragraphs are neither eyewitness to the occurrence nor have they made any statement substantiating any suspicion against this petitioner. Inspite of the petitioner being in custody since 15.1.2022, he has not been put on T.I. Parade and charge sheet has been submitted in the case. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner not having been put on T.I. Parade inspite of being in custody since 15.1.2022 and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Amarpur P.S. Case no. 580 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
