The petitioner seeks bail in connection with Kursela P.S. Case No.115 of 2020 registered for the offence under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is to have caused firearms injury upon the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case, where, petitioner is not named in the FIR. It is submitted that nothing incriminating articles have

No.18846 of 2024(2) dt.21-03-2024 2/2 been recovered from the conscious physical possession of this petitioner, during course of investigation, which may connect this petitioner with the present set of occurrence. It is also submitted that no injury was caused upon the informant, where, the dispute has been settled in between the parties through compromise. It is further submitted that petitioner is in custody since 03.08.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Kursela P.S. Case No.115 of 2020 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar.
