JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2017 The petitioner seeks regular bail in connection with Special Case No. 17/17 arising out of Jogbani P.S. Case No. 90 of 2017, registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(i) and 38(a) of the Bihar Prohibition and Excise Act, 2016 and Section 20, 22, 21C, 24 of the NDPS Act.

Allegation against the petitioner is of recovery of Dialex DC Syrup - 579@ 500 100 ML, Sasmo Proxyvan Plus Capsules and Nepali currency.

It has been submitted on behalf of the petitioner that he only happens to be the driver of the vehicle from which the alleged recovery as been made and has nothing to do with the seized articles. Further he has no criminal antecedent and has been

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Araria, in connection with Special Case No. 17/17 arising out of Jogbani P.S. Case No. 90 of 2017.

It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
