The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 23.06.2017, passed in Cr. Misc. No. 17871 of 2016, on the ground that the petitioner is suffering in custody since 21.10.2016. The petitioner has been implicated in false case, he has never demanded anything, he has no criminal antecedent.

As a matter of fact, the marriage has taken place in the year 2004 and the name of the wife of the petitioner was Anita Devi. During treatment she died, informant was informed, who along with his son participated in the funeral of the deceased and thereafter, lodged this false case.

Patna High Court Cr.Misc. No.16990 of 2018(3) dt.18-04-2018 2/2 The learned A.P.P. opposes the prayer of bail by submitting that from the report of learned trial court judge, it reveals that trial is in progress and one prosecution witness has already been examined.

In the facts and circumstances stated above, at present, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected in connection with Sessions Trail No. 139 of 2017, arising out of Pipra P.S. Case No. 190 of 2015, pending in the court of learned F.T.C.-2, Supaul.

However, considering the detention of the petitioner, the learned trial Court is directed to expedite the trial and conclude the same preferably within six months, from date of receipt/production of a copy of this order, after keeping the same on priority basis.
