Having regard to the nature of allegation against the petitioner for offence under section 364/34 of the Indian Penal Code and that the police after investigation has submitted charge sheet only for offence under sections 363, 342/34 of the Indian Penal Code, this application for anticipatory bail definitely has become infructuous, inasmuch as all the offences for which charge sheet has been submitted by the police are bailable in nature. That being so, this application is dismissed as having become infructuous.
The petitioner, therefore, may surrender and seek regular bail and in case he does so, the same shall be disposed of on its own merit without being prejudiced by anything said in this order. (Mihir Kumar Jha, J) surendra/- U
