JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2017 The petitioner seeks regular bail in connection with Kankarbagh P.S. Case No. 137 of 2017, registered for offences punishable under Section 302/34 of the Indian Penal Code. Allegation against the petitioner is of killing his own father.
It has been submitted on behalf of the petitioner that petitioner was informant in this case but later on he has falsely been implicated in this case only on the basis of suspicion and except that there is nothing against him. Further he has been in judicial custody since 06.03.2017.
Learned counsel for the State opposed the prayer for bail and submitted that one witness has stated that the petitioner was seen coming out from the room of the deceased and his statement
Patna High Court Cr.Misc. No.31735 of 2017 (3) dt.30-08-2017 was also recorded under Section 164 Cr.P.C. coupled with the fact that petitioner himself has confessed his guilt in this case. Having heard both sides, considering the facts and circumstances of the case and the materials available on record, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of one year. (Vinod Kumar Sinha, J) sunil/- U T
