2. The petitioner seeks bail in connection with Dariyapur Bazar PS Case No.373 of 2024 dated 06.07.2024, instituted for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. The prosecution case, in brief, is that on account of dispute with regard to non-payment of the due amount, on the instigation of the petitioner, co-accused, Tinku Nut and Raja Nut assaulted the father of the informant and co-accused Vijay Nut is said to have assaulted the deceased by means of sickle in his abdomen due to which he received serious injury and died during the course of treatment.

4. Learned counsel for the petitioner submits that there is no allegation of assault against the petitioner. It is alleged that the petitioner is the order giver. Petitioner was not present at the place of occurrence when the occurrence took place but he has implicated due to village politics. Specific allegation is against Vijay Nut that he assaulted the deceased by means of sickle in his abdomen. Lastly, it is submitted that the petitioner is in custody since 08.04.2025 having clean antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Chapra, Saran, in Dariyapur Bazar PS Case No.373 of 2024.

7. The application stands allowed.
