The petitioner is apprehending his arrest in connection with Laukahi P.S.Case No.64/2018 , registered for offences punishable under Sections 341, 323, 504, 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the D.P.Act. Allegation against the petitioner is of subjecting the informant-wife of cruelty with respect to demand of dowry and ousted her also from the house.

Submission of the learned counsel for the petitioner is that he is still ready to keep her, however, on the other hand the learned counsel for the O.P.no.2 has submitted that the

Patna High Court CR. MISC. No.15689 of 2019(2) dt.26-03-2019 2/3 petitioner has solemnized second marriage after his appointment as the constable and no maintenance amount is being paid to her.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Jhanjharpur, Madhubani in connection with Laukahi P.S.Case No.64 of 2018 dated 2.5.2018, subject to condition as laid down under Section 438

(2) of the Code of Criminal Procedure with condition to pay maintenance amount of Rs.4,000/- (Rupees Four Thousand) per month for a period of one year .

In the meantime the O.P.no.2 is at liberty to file a maintenance case before the learned Family Court and in which the petitioner shall also co-operate in disposal of the same and payment of the maintenance amount is subject to any order passed by the learned Family Court.

With the aforesaid observation, this application is
