JUSTICE ARUN KUMAR ORAL ORDER 13-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Dhangai PS Case No. 69 of 2017 registered under Sections 302/34 of the IPC and Section 27 of the Arms Act.

Learned Counsel for the petitioner submits that the petitioner is a witness in a criminal case lodged against the informant by one Dhanraj Paswan and therefore has falsely been implicated. However, there is no any such statement or document on record showing the petitioner being a witness and the allegation against the petitioner is that he caught hold the victim thereafter others shot at him.

Having considered the said facts and circumstances, the payer for bail of the petitioner is rejected. If so advised, the petitioner may renew the prayer for bail after one year if the trial does not conclude. (Arun Kumar, J.) Snkumar/- U T
