The petitioner seeks pre-arrest bail in connection with Runisaidpur P. S. Case No.464 of 2019 registered under Sections 498-A/307/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

It is submitted by the learned counsel for the petitioner that the husband of the informant, namely, Raushan Kumar @ Raushan Thakur has already been granted pre-arrest bail by a Bench of this Court vide order dated 06.03.2020 passed in Cr. Misc. No.12662 of 2020. The petitioner, being mother-in-law of

No.12398 of 2020(2) dt.03-07-2020 2/2 the informant, is living separately from the informant and her husband and has nothing to do with the day-to-day matrimonial life of the couple. It is further contended that the alleged injuries caused to the informant have been found simple in nature. The petitioner being an old lady, has got roots in the society and is not likely to abscond or tamper with the evidence. Learned Additional Public Prosecutor for the State has opposed the prayer for grant of pre-arrest bail to the petitioner.

Considering the submissions advanced at the Bar and the fact that the husband of the informant has already been granted bail by a Bench of this Court, the petitioner named above is directed to be released on bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Runisaidpur P. S. Case No.464 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
