JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 22.06.2018 in connection with Hilsa P.S. Case No. 295 of 2018 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
As per prosecution case, one unknown dead body was recovered and the above stated Hilsa P.S. Case No. 295 of 2018 was registered on 04.06.2018 against unknown. However, in course of investigation, petitioner was arrested on the basis of tower location of his mobile and subsequently, one shirt and clutch wire were recovered from the house of the petitioner. The prosecution claims that aforesaid recovered shirt was of
Patna High Court CR. MISC. No.13297 of 2019(3) dt.21-05-2019 2/2 deceased but the aforesaid shirt was not put on T.I.P. The petitioner confessed his guilt and on the basis of his confessional statement, some other accused were also arrested. Learned counsel appearing for the petitioner submits that co-accused Khurshid Alam @ Md. Khurshid Alam, Devendranath Dwivedy @ Devendra Diwavedi and Vijay Kewat have already been granted privilege of bail by different Benches of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that investigation against the petitioner has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Hilsa, Nalanda in connection with Sessions Trial No. 583/18/Reg. 284/18 arising out of Hilsa P.S. Case No. 295 of 2018.
