JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Gararu P.S.Case No. 100 of 2017 registered under Sections 302/34 of the Indian penal Code and 27 of the Arms Act. Allegation in brief is that two persons came on motorcycle concealing their faces and Munsi of the Power Station Munna Singh disclosed about deceased identity to them thereafter both shot at his abdomen and escaped away. It is alleged that for nonfulfilling the demand of levy, deceased was killed. Learned counsel for the petitioner submits that petitioner is not named in the FIR, only later on informant has stated about the complicity of the petitioner; as well as a co-accused Rinku Singh and another co-accused Krishna Singh, in their confessional statements have disclosed name of the petitioner as an accomplice,

No.4637 of 2018 (3) dt.17-02-2018 2/2 except that there is no other material against him though coaccused Krishna Singh has been admitted to bail by a co-ordinate Bench of this Court vide order dated 06.02.2018 passed in Cr. Misc. No. 1360 of 2018 and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Tulsi Sao, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Guraru P.S. Case No. 100 of 2017. (Arun Kumar, J) Sujit/- U
