JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 11-05-2015 In the present application filed under section 482 of the Code of Criminal Procedure, the petitioner has challenged the order dated 22.03.2006 passed by the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Laheri P.S.Case No. 135 of 2005, whereby, finding a prima facie case to be made out for the offences punishable under sections 406, 409 and 420 of the Indian Penal, cognizance has been taken and the petitioner has been summoned to face trial.

Apparently, the order of 2006 is being challenged before this Court after nine years in 2015. The allegations made in the First Information Report do attract the ingredients of the

Patna High Court Cr.Misc. No.20133 of 2015 dt.11-05-2015 2/2 offences alleged.

In that view of the matter, I find no merit in the application. Accordingly, the application is dismissed. (Ashwani Kumar Singh, J) Pradeep/- U T
