JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 372, 366/34 of the Indian Penal Code.
The prosecution case is that co-accused Mukhtar Alam entered into the house of the informant, ravished her and thereafter promised to marry with her. It is alleged that co-accused Ansar Alam and Sahiro took the informant to Luckhnow where co-accused Mukhtar Alam again ravished her. The accused persons planed to push the informant into flash trade but she managed to escape from the captivity.
It is submitted by learned counsel for the petitioner that complaint was filed after two and half months of the occurrence. The main co-accused Mukhtar Alam has been granted regular bail vide Cr. Misc. No. 33490 of 2015 on
Patna High Court Cr.Misc. No.19010 of 2016 (3) dt.06-05-2016 2/2 statement of the parties that informant has married with Mukhtar Alam. It is further submitted that there is no direct allegation against the petitioner and petitioner is lady having no criminal antecedent. A statement to that effect has been made in para 3 of the petition.
Considering the aforesaid facts, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 55 of 2014, G.R. No. 378 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
