17-06-2015 Heard Sri Raj Kumar, learned counsel for petitioners and learned Addl. Public Prosecutor.

Two petitioners, apprehending their arrest in Sarsi P.S. Case No. 184 of 2014 registered for the offence under Sections 461, 379/511 of the Indian Penal Code, have prayed for grant of anticipatory bail.

Learned counsel for petitioners submits that petitioners' name has transpired in confessional statement of one of the co-accused. He further submits that petitioners have got clean antecedent. He accepts that investigation in the case is still continuing.

In view of the facts and circumstances as well as

No.20028 of 2015 (2) dt.17-06-2015 2/2 nature of accusation and the fact that investigation is still continuing, in the event of their arrest or surrender before the court below within a period of one month from today, let the petitioners namely Panna Lal Mandal and Gajendra Mukhiya @ Gajendra Pahadia @ Gajendra Kumar Mukhiya be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sarsi P.S. Case No. 184 of 2014 (G.R. No. 6354 of 2014), subject to condition as laid down under Section 438(2) of the Cr.P.C.

It is made clear that if during investigation, the case is found true against the petitioners and charge-sheet is submitted, thereafter, petitioners will have to appear before the court below and make a prayer for regular bail.
