02. 13.07.2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Sections 420 and 120(B) of the Indian Penal Code and Section 30(a) of the Prohibition of Bihar Excise (Amendment) Act, 2016.

It is contended that, as per allegation, 450 litres of foreign liquor were recovered from the truck. However, it is contended that allegation upon the petitioner is that he came before the police and requested the authorities to release the truck along with the goods. It is further contended that the coaccused persons have already been granted bail by a Co-

Patna High Court Cr.Misc. No.31803 of 2017 (2) dt.13-07-2017 ordinate Bench of this Court. Petitioner claims that he is having clean antecedent and is in custody since 11.03.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-Cum-Special Judge, Aurangabad in connection with Auangabad Muffasil P.S. Case No. 27 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
