The petitioner seeks anticipatory bail in connection with Ariyari PS case no. 169 of 2016 registered for the offences punishable under Sections 406, 409, 419, 420 and 34 of the Indian Penal Code.

The allegation is regarding one accused namely Shambhoo Yadav, owner of Maa Dhaneshwari Enterprises Rice Mill having taken paddy from the farmers through the petitioner herein and thereafter the money of the said paddy was not paid to the farmers.

The learned counsel for the petitioner submits that the said Shambhoo Yadav has already paid the money to the farmers

Patna High Court Cr.Misc. No.10567 of 2018 (2) dt.26-02-2018 2/2 and he has been granted bail by the learned court below by an order dated 19.1.2018, which has been filed today and is being placed on the record. It is submitted that since the matter has been settled, there is no impediment in granting anticipatory bail to the petitioner herein.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sheikhpura in connection with Ariyari PS case no. 169 of 2016, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
