The petitioner apprehends her arrest in connection with Nokha (Dharampura) P.S. Case no. 229 of 2019, registered under Section 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

The accusation is that petitioner, being the candidate for appointment on the post of Niyojit Primary Teacher for Gram Panchayat-Dharmpura, Block-Nokha, submitted self-attested marks sheet bearing Roll Code 7332, Roll No. 323 of the year 1987, showing 339 marks obtained in Matric examination and secured Third Division in the said examination, but, on verification, she found fail in Matric examination.

No.12753 of 2020(6) dt.08-01-2021 2/2 Learned counsel for the petitioner submits that, in fact, the petitioner was shown failed in Matric examination, but on re-calculation her number was found incorrect in English subject. Thereafter, correction was made in her marks-sheet and, accordingly, certificate was also issued about passing of the petitioner in third division, which would appear from Annexure-4 to the supplementary affidavit. The petitioner is a lady and she has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sasaram (Rohtas) in connection with Nokha (Dharampura) P.S. Case no. 229 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
