The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 387, 389, 34 of the Indian Penal Code.

Prosecution case is that there is Gairmazarua path in front of the house of the informant which was blocked by the petitioners by surrounding with bamboo stick and due to which he and his family were facing much difficulty. It is alleged that when the informant told to open the blockage of paty, then they were making demand of Rs. 30,000/-.

It is submitted by learned counsel for the petitioners that petitioners are innocent and have been falsely

Patna High Court CR. MISC. No.25025 of 2021(2) dt.09-12-2021 2/2 implicated in this case due to land dispute. He submits that petitioners and informants are neighbor. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application.

Learned APP for the State opposed the prayer for bail and submits that there is allegation of demanding of Rs. 30,000/- from the informant for removing obstruction from Gairmazarua path.

Considering the facts and circumstances of the case, the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Paharpur P.S. Case No. 401 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
