JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 31-03-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Bakhri P. S. Case No. 14 of 2016 registered under Sections 447, 341, 506, 379, 504, 384 and 34 of the Indian Penal Code. It is contended that the petitioners have been implicated in a false case due to prevailing land dispute between the parties. The informant of the case has filed a suit bearing Title Suit No. 40 of 2014 in the court of Sub-Judge, Begusarai seeking relief for declaration of his title over the land in
Patna High Court Cr.Misc. No.13718 of 2016 (2) dt.31-03-2016 2/2 question and in the said suit the petitioners have been made defendants. It is further contended that the petitioners are cousin of the informant and it is highly unbelievable that they would have demanded ransom from the informant. It is also contended that the petitioner no. 1 and the informant are advocate practicing in civil court, Begusarai.
Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Begusarai in Bakhri P. S. Case No. 14 of 2016 , subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
