JUSTICE ARUN KUMAR ORAL ORDER 28-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 26.8.2017, seeks bail in Bounsi PS Case No. 187 of 2017 registered under Sections 341, 323, 307, 504 and 506/34 of the IPC.

The allegation in brief is that due to land dispute the petitioner gave a lathi blow over head of the informant's father causing head injury, another accused Prabhu Mandal assaulted on the leg of the informant and thereafter other accused persons also assaulted with fists and slaps.

Learned Counsel for the petitioner submits the informant's father died during treatment after 12 days of the occurrence, there is land dispute between the parties, only a single blow is said to have been given by the petitioner, he has no criminal antecedent and is in custody since 26.8.2017.

Having considered the said facts and circumstances, the petitioner, namely, Sambhu Mandal is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM III, Banka in connection with Bounsi PS Case No. 187 of 2017.
