JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.
As per prosecution case, 7-8 persons are said to have snatched Rs. 30,000/- and 3 mobile sets of the informant and a mobile of his friend.
It is submitted on behalf of the petitioner that the petitioner is not named in the FIR. No incriminating article has been recovered from the possession of the petitioner. His name has surfaced in this case on his confessional statement before the police. He has not been put on T.I. parade. He is in custody since 27.04.2017.
Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.34026 of 2017 (2) dt.20-07-2017 2/2 bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-II. DistrictNalanda at Biharsharif in connection with Rahui P.S.Case No. 80 of 2017.
