Petitioner, already in custody, seeks bail in connection with Bibhutipur P.S. Case No. 226/2017, registered under Section 420 of the Indian Penal Code as well as under Section 66 of the I.T. Act.

Allegation in brief is that the ATM card of the informant was changed fraudulently by one stranger at the ATM kiosk and also withdrew Rs. 20,000/- and odd. Learned counsel for the petitioner submits that the ATM card of the informant has not been recovered from possession of the petitioner nor he was put on TIP and only on the basis of his confessional statement has been made accused in this case.

No.21809 of 2018(2) dt.13-04-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Pintu Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to this satisfaction of learned ACJM, Rosera in connection with Bibhutipur P.S. Case No. 226 of 2017.
