ANJANA MISHRA ORAL ORDER 20-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 10.11.2017 in connection with Barauni (Chakia) P.S. Case No.427 of 2017 registered for the offence under Sections 379 and 411/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the mobile, which is alleged to have been recovered, was the same which is alleged to have been taken over from the informant, but the petitioner was not aware that the mobile in question was a stolen mobile. He further submits that the alleged seizure has not been made in presence of the independent witness and till date, the petitioner has not been

Considering the aforementioned facts and circumstances and that the petitioner is a man of clean antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Chakia) P.S. Case No.427 of 2017.
