The petitioners apprehend their arrest in connection with Brahmpur P.S. Case No. 337/2018 registered for the offences punishable under Sections 498A/323/354/34 of the Indian Penal Code.
As per the prosecution case, on 13.07.2018 while the informant was in her house, all the accused persons assaulted her with fists and slaps and petitioner no. 1 dragged her by pulling her hairs.
It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.15939 of 2020(6) dt.18-01-2021 2/2 marriage of petitioner No. 1 and the informant took place 14 years ago and out of the wedlock one son and one daughter was born who are living with the petitioner No. 1. It is further submitted that petitioner No. 1 is ready to keep the informant with full honour and dignity. It is further submitted that there is a counter case also against the informant and others bearing Complaint Case No. 727 of 2018 in which cognizance has been taken on 12.09.2018.
Considering the aforementioned facts and circumstances, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Buxar, in connection with Brahmpur P.S. Case No. 337/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
