JUSTICE SHIVAJI PANDEY ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Ballia P.S. Case No.253 of 2015, registered for the offence punishable under Sections 147, 447, 323, 324, 307, 337, 354 and 379 of the Indian Penal Code. Allegation has been made against the petitioner to have caused injury on the head of the informant by iron rod. Learned counsel for the petitioner submits that the dispute took place on account of land dispute and both the sides have assaulted each other.

Looking to the nature of allegation, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

Patna High Court Cr.Misc. No.5828 of 2018 (2) dt.01-02-2018 2/2 Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below after calling the records including the injury report pass appropriate order on the same day without being influenced by the order of this Court.
